Official Rules & Terms

The Frosted Treasure Hunts promotion (the “Game” or “Promotion”) is sponsored and administered by Valley of the Sun Medical Dispensary, a marijuana establishment licensed by the State of Arizona (License No. [LICENSE NUMBER]), located at [SPONSOR ADDRESS], Goodyear, Arizona [ZIP] (the “Sponsor”). The Sponsor’s statutory agent / person authorized to accept service of process is [STATUTORY AGENT NAME & ADDRESS].

These Official Rules govern the Promotion. By entering, each participant agrees to be bound by these Official Rules and by the decisions of the Sponsor, which are final and binding in all matters relating to the Promotion.

The Promotion is open only to individuals who are 21 years of age or older at the time of entry and who are legal residents of, and physically located within, the State of Arizona at the time of entry and redemption. Void outside Arizona and void where prohibited or restricted by law.

Employees, officers, owners, and agents of the Sponsor, and their respective affiliates, and the immediate family members (spouse, parent, child, sibling, and their respective spouses) and household members of each are not eligible to participate or win. Age is verified twice: a 21+ age gate on this site at entry, and an in-person check of a valid, government-issued 21+ photo ID before any prize is released. Misrepresenting your age, identity, or location voids any entry and any claim.

The Promotion begins on [START DATE, TIME] and ends on [END DATE, TIME] (Arizona / Mountain Standard Time) (the “Promotion Period”), unless earlier suspended or terminated by the Sponsor. The Promotion runs in recurring weekly rounds that reset on a fixed schedule (Arizona time). The Sponsor’s clock is the official timekeeper for the Promotion.

No purchase or payment of any kind is necessary to enter, play, or win, and a purchase or payment will not increase your chances of winning. The Game is free to play. No increment or added consideration is required to enter. Standard message and data rates charged by your mobile carrier or internet provider may apply to your use of the site and are your responsibility.

To enter, create a free player account on this site (name, email address, and mobile phone number required) and pass the 21+ age gate. Game tokens bearing unique, single-use codes are placed within designated public search areas. Open the map to find an active search zone, locate the token, and scan its single-use code (or enter the printed code) while signed in.

• No marijuana or other regulated product is ever placed, hidden, or left in any public area. Only game tokens/codes are placed. All prizes are fulfilled exclusively on the Sponsor’s licensed premises (see Section 7).
• Each code is single-use; the first valid claim wins the prize associated with it.
• Limit one (1) prize per person per weekly round. Limit one (1) account per person. Multiple or automated entries are void.

A valid winning entry is the first eligible participant to scan or enter a valid, unclaimed code associated with a prize during an active round, subject to these Official Rules. Odds of winning depend on the number of prizes available, the number of eligible participants, the timing of entries, and each participant’s skill and diligence in locating a token. Potential winners are notified through their player account and by email, and a digital prize voucher is issued to the account. In the event of a dispute or a tie as to a single code, the entry received first as recorded by the Sponsor’s systems governs; if that cannot be determined, the Sponsor will select the winner from the affected entries in a manner it deems fair.

Prizes vary by round and may include merchandise, store credit, or, where lawful and subject to Section 8, marijuana or marijuana products. The approximate retail value (“ARV”) of each prize is [ARV PER PRIZE]; the total ARV of all prizes in the Promotion is [TOTAL ARV]. The actual value may vary; no difference between stated and actual value will be awarded.

All prizes are redeemed only in person at the Sponsor’s licensed premises and require a valid, government-issued 21+ photo ID. Sponsor staff verify the winner’s identity and age before any prize is released, in accordance with Arizona law. A voucher that has expired, has already been redeemed, or has been voided cannot be claimed. Any prize consisting of marijuana or marijuana products is transferred only through a lawful, licensed in-store transaction and is subject to all applicable purchase and possession limits and regulations.

Prizes are awarded “as is,” are non-transferable, and have no cash value except where required by law. No prize substitution, transfer, or cash equivalent is permitted except that the Sponsor reserves the right to substitute a prize of equal or greater value if an advertised prize becomes unavailable. All prizes are subject to availability and to all applicable federal, state, and local laws and regulations.

Where a prize consists of marijuana or marijuana products, the following apply in addition to the terms above:

• The winner must be 21 years of age or older and present a valid, government-issued 21+ photo ID at the Sponsor’s licensed premises.
• The prize is dispensed solely through a lawful, on-premises licensed transaction by the Sponsor and is subject to all applicable statutory purchase and possession limits.
• No marijuana product is shipped, delivered, mailed, hidden, or placed in any public area at any point in the Promotion. Nothing in the Promotion authorizes possession, transport, or use of marijuana by any person under 21.
• The Sponsor may decline to award a marijuana prize to any person who cannot lawfully receive it, and may substitute a non-marijuana prize of equal or greater value or forfeit the prize, at its discretion and consistent with law.

Warning: Do not use marijuana if you are under twenty-one years of age or pregnant. Keep marijuana out of reach of children.

All federal, state, and local taxes on any prize, and any expense not expressly stated as included, are the sole responsibility of the winner. Where the value of a prize or prizes awarded to a winner requires tax reporting (including, where applicable, IRS Form 1099 for prizes valued at $600 or more in a calendar year), the winner must provide a completed IRS Form W-9 and valid taxpayer identification before the prize is released, and the Sponsor will report and/or withhold as required by law. Failure to provide required tax information may result in forfeiture of the prize.

One account and one identity per person. Tampering with tokens, codes, the site, or the Promotion; using bots, scripts, or automated means; exploiting bugs; sharing, selling, or transferring codes or vouchers; spoofing location; or attempting to enter or claim on behalf of a person who is not 21+ are prohibited and void the entry. The Sponsor may disqualify any participant and void any entry or claim obtained through fraud, tampering, or violation of these Official Rules, and may pursue any remedy available at law. The Sponsor is not responsible for lost, late, misdirected, garbled, or incomplete entries, or for technical, network, or device failures.

Except where prohibited by law, acceptance of a prize constitutes the winner’s consent for the Sponsor to use the winner’s chosen display name, city of residence, and voluntary statements for advertising and promotional purposes in any media, worldwide, without further notice, review, approval, or compensation. Winners may choose how (or whether) they appear on any public winners feed; the Sponsor does not publish a winner’s exact location, contact details, or full identity on any public surface.

To play you create an account with your name, email address, and mobile phone number. Information is collected and used as described in the Sponsor’s Privacy Policy. The Sponsor collects only what the Promotion needs to operate and does not publish participants’ exact locations or personal details on public surfaces.

Marketing communications are sent only with your consent. By opting in you provide prior express written consent to receive automated marketing calls and text messages and/or marketing emails from or on behalf of the Sponsor at the number and email you provide; consent is not a condition of entry or of any purchase. Message frequency varies; message and data rates may apply. You may withdraw consent and unsubscribe at any time (reply STOP to text messages, use the unsubscribe link in emails, or update your account preferences). Any marketing directed to you will use a method to verify you are 21 or older before that communication, and will identify the Sponsor as required by law.

By entering, each participant releases and holds harmless the Sponsor and its owners, officers, employees, and agents from any and all liability, claims, injury, loss, or damage of any kind arising out of or in connection with participation in the Promotion or the acceptance, possession, use, or misuse of any prize, to the fullest extent permitted by law. The Promotion and the site are provided “as is” without warranty of any kind. Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.

The Promotion and these Official Rules are governed by the laws of the State of Arizona, without regard to conflict-of-laws principles. Except where prohibited, any dispute arising out of or relating to the Promotion shall be resolved individually, without resort to any class action, in the state or federal courts located in Maricopa County, Arizona, and each participant consents to the jurisdiction and venue of those courts. The Promotion is subject to all applicable federal, state, and local laws and regulations, including the registration and disclosure requirements applicable to prize promotions in Arizona.

The Sponsor reserves the right to modify, suspend, cancel, or terminate the Promotion, or to amend these Official Rules, at any time, for any reason, including if fraud, technical failure, or any other factor beyond the Sponsor’s control impairs the integrity of the Promotion. Continued play after a change constitutes acceptance of the updated Official Rules. If any provision of these Official Rules is held invalid or unenforceable, the remaining provisions remain in full force and effect. The Sponsor’s failure to enforce any provision is not a waiver of that provision.
